A federal district court in Illinois denied Health Care Service Corporation’s motion to dismiss an employee’s action for violations of ERISA and the Mental Health Parity and Addiction Equity Act, relating to the denial of benefits for his beneficiary’s in-patient mental health and behavioral treatment. The court held that the employee plausibly alleged that the plan’s 24-hour on-site nursing requirement violates the Parity Act.
