A federal district court in Utah granted in part a Caliber Home Loans Inc. employee’s motion for summary judgment in this ERISA and Mental Health Parity and Addiction Equity Act action against United HealthCare Insurance Co., United Behavioral Health, and Caliber’s Welfare Benefits Plan, challenging the denial of benefits for the employee’s son’s residential treatment center, and denied United’s motion for summary judgment. The court said that United’s denial wasn’t reasonable under the arbitrary and capricious standard of review. And the court denied as moot the parties’ motions for summary judgment on the employee’s Parity Act claims.
