A proposed class action arising out of defendant Marathon Petroleum Company LP’s alleged breach of defendant Andeavor LLC’s 2018 Incentive Compensation Program partly survived a motion to dismiss in the U.S. District Court for the Western District of Texas. The plaintiffs stated a plausible breach-of-contract claim for failure to pay full bonuses in 2018, the court said, but because the plaintiffs seek money damages, their claim for specific performance must be dismissed.
