Car Auction Company Worker Can Try One Claim in Benefits Dispute

A former Russo & Steele LLC employee seeking higher benefits under an executive compensation plan can go to trial on one claim, a federal judge said in an opinion resolving most issues in favor of the Arizona car auction company.

A trial is needed to determine whether the employee’s payout was properly reduced to account for a $30,000 distribution he may have received in 2016, Judge Roslyn O. Silver said. The employee disputed ever receiving this amount, and the parties provided “no further evidence or information” about the whereabouts of the funds, Silver said in an opinion issued Oct. 25 ...
