Boilermaker Pension Fund Sued Over Benefit Suspensions

Three retired boilermakers filed a proposed class action accusing a multiemployer pension fund of wrongly suspending benefits based on an “unwritten rule” banning retirees from taking certain jobs.

Thomas Phillips, Kevin Murphy, and Michael Egger say the Boilermaker-Blacksmith National Pension Fund wrongfully suspended their pensions and demanded repayment after they took unrelated jobs after retiring from boilermaker work. This wasn’t authorized by the plan, which prohibited only post-retirement work as a boilermaker, the retirees said in a July 17 complaint filed in the District of Kansas.
