Boilermaker-Blacksmith Pension Fund Faces Class of 100 Retirees

A group of retired boilermakers claiming their pension benefits were wrongly terminated won a court order certifying their case as a 100-person class action.

The Boilermaker-Blacksmith National Pension Trust opposed having the case certified as a class action, arguing that about two-thirds of the proposed class members lack viable claims based on the plan’s deadline for filing suit.

Judge Toby Crouse wasn’t persuaded, saying that “numbers alone” aren’t the only factor in class certification. Even if the class includes only 34 members, those members would still be “geographically dispersed” and would be seeking prospective relief that could benefit future retirees, ...
