AutoZone Suit Over 401(k) Fees, GoalMaker Platform Gets Boost

Participants in AutoZone Inc.‘s 401(k) plan notched a win in their lawsuit challenging the plan’s fees and investments, when a federal magistrate judge in Tennessee recommended the case be certified as a class action covering tens of thousands of people.

AutoZone argued the named plaintiffs, Michael Iannone Jr. and Nicole James, lacked standing to bring some of their claims, because they invested in only 10 of the 16 investment funds challenged by their lawsuit. Magistrate Judge Tu M. Pham disagreed, saying their lawsuit challenged AutoZone conduct that applied to all the challenged funds, giving them standing to press these claims. ...
