Arkansas Pharmacy Drug-Pricing Law Invalid: 8th Circuit

Pharmacy benefit managers, including companies like Express Scripts and CVS Health, scored a victory in a court case determining whether a state law that required disclosure of generic drug pricing is invalid because it is preempted by federal law.

The U.S. Court of Appeals for the Eighth Circuit held June 8 that an Arkansas law that set a floor on prices that PBMs can pay to pharmacies for generic drugs is preempted by both ERISA and the Medicare Part D drug benefit program.
