The federal government should weigh in on a dispute over how to calculate the pension withdrawal liability owed by an employer that already partially withdrew from its retirement fund, the Seventh Circuit said.
The appeals court on Tuesday invited the federal government to file an amicus brief in a case by a concrete manufacturer claiming it was overcharged when it withdrew from a Teamsters pension fund. The Seventh Circuit, which heard arguments in the case earlier this month, asked the government to say within 20 days whether it will accept the invitation and file a brief.
