Amy’s Kitchen Ordered to Face Trimmed 401(k) Plan Fee Challenge

Amy’s Kitchen Inc. must defend allegations that its 401(k) plan wrongly offered funds in needlessly expensive share classes, but a judge said it’s free from claims that the plan’s administrative fees were too high.

Participants in the food maker’s retirement plan have viable claims that 13 of the plan’s mutual funds are inappropriately expensive, because they compared these fund to cheaper versions of the same investments that could have been selected instead, Judge Rita F. Lin said Monday. Lin dismissed their challenge to four other funds unless they can identify better benchmarks for their fee levels.
