American Airlines Requests Limits on 401(k) Anti-ESG Injunction

American Airlines Inc. asked the judge who recently ordered it to purge socially-conscious investing from its 401(k) plan to revise his injunction so that it can be “implemented effectively.”

American on Tuesday asked Judge Reed O’Connor to revise and clarify his September judgment, which limited the airline’s ability to work with certain asset managers and blocked it from various activities motivated by environmental, social, and corporate governance goals. Without revisions to the injunction, American may be forced to entirely shutter the plan’s brokerage window, it said.
