American Airlines Pilots Revive Suit Seeking Paid Military Leave

American Airlines Group Inc. pilots on Tuesday revived part of their proposed class action seeking paid leave for time they took off to serve in the military.

The case turns on whether military leave is comparable to leave for jury duty or bereavement in terms of duration, purpose, and the level of control pilots exert over their absences, the US Court of Appeals for the Third Circuit said. These questions involve factual disputes that must be resolved at trial, the court said in an opinion reviving the pilots’ claims under the Uniformed Services Employment and Reemployment Rights Act.
