Universal Services of America LP and Allied Universal Topco LLC must face claims that they failed to monitor and rein in their 401(k) plan’s annual administrative fees, according to an order docketed Feb. 2.
Two Allied Universal workers say in their proposed class action that these fees were about $96 per person, which is “nearly triple” what comparably sized plans paid for administrative services. The private security company disputed these allegations as being based on cherry-picked data that didn’t properly account for variations in the administrative services received by different retirement plans.
