Alight Seeks Exit From Colgate Worker’s 401(k) Cyber Theft Suit

Alight Solutions LLC wants out of litigation over an alleged theft of more than $750,000 from a former Colgate-Palmolive Co. employee’s 401(k) account, telling a Manhattan federal judge that it can’t be liable as an ERISA fiduciary.

The administrative services Alight performed for Colgate’s retirement plan were “ministerial” and didn’t involve the type of control or discretion that would cause the company to qualify as a fiduciary subject to liability under the Employee Retirement Income Security Act, Alight said Monday in a motion for summary judgment.
