Alcoa Keeps Its Victory in Retirees’ Pension Risk Transfer Suit

Alcoa USA Corp. retirees challenging the company’s decision to swap their pensions with third-party annuities are stuck with a decision dismissing their proposed class action for lack of a sufficient injury.

Judge Loren L. AliKhan on Tuesday declined to change her 2025 decision favoring Alcoa and denied the retirees’ request to file a new complaint with more details about their alleged injury. The retirees didn’t show a change in controlling law or newly-discovered evidence that would justify the “extraordinary” step of reconsidering the prior decision, AliKhan said.
