AIG Former Worker Gets Green Light for Pension Calculation Suit

A former American International Group Inc. employee can argue that she was denied the full pension benefits she was promised despite the insurer’s argument that she didn’t complete her plan’s internal appeals process.

It’s “far from clear” that the employee failed to exhaust her internal remedies under the plan’s two-step appeal process, Judge Michael W. Fitzgerald of the US District Court for the Central District of California said Tuesday. The parties disagree over whether her October 2023 letter seeking higher benefits was an initial claim or an appeal of an earlier decision establishing a lower benefit amount, Fitzgerald said.
