Aetna’s Arbitration Appeal Against Aramark Backed by Trade Group

Aetna Life Insurance Co.'s appeal seeking arbitration in a dispute over Aramark Services Inc.'s health plan drew support from a trade group representing the health insurance industry, which said an arbitrator should have decided where the dispute is heard.

America’s Health Insurance Plans Inc. on Tuesday sought permission to file an amicus brief supporting Aetna’s effort to force the dispute into arbitration. The contract under which Aetna serviced Aramark’s health plans mandates that an arbitrator—and not a federal judge—will decide whether a given dispute belongs in court or arbitration, AHIP told the US Court of Appeals for the Fifth Circuit. ...
