Aetna Denied Pause in Class Action Over Disability Clawbacks

Aetna Life Insurance Co. lost its bid to pause litigation over how it recoups disability payments out of personal injury settlements, when a federal judge concluded that the Third Circuit was unlikely to hear the insurer’s appeal.

Aetna’s appeal, which asks the US Court of Appeals for the Third Circuit to weigh whether the case should be certified as a class action, is plagued by procedural issues that will likely result in the appeals court refusing to consider it, Judge Matthew W. Brann said Tuesday.
