ADP 401(k) Investors Challenging Fees Lose Latest Jury Trial Bid

A 50,000-person class action challenging fees tied to the Automatic Data Processing Inc. 401(k) plan won’t be tried by a jury, a federal judge reaffirmed.

Judge Evelyn Padin of the US District Court for the District of New Jersey upheld a magistrate judge’s 2024 decision striking the plan participants’ request for a jury trial. Their claims for fiduciary breach under the Employee Retirement Income Security Act seek equitable relief that must be weighed by a judge—not a jury—under binding case law from the US Court of Appeals for the Third Circuit, she said in a Monday unpublished order.
