Walgreens Wins Dismissal of Health Records Retrieval Fee Suit

Walgreen Co. doesn’t have to defend claims it overcharged a customer for retrieving and copying her pharmacy records.

Carolyn Moya waived her right to sue Walgreens for violating Wisconsin’s statutory limit on the amount a health-care provider may charge for fulfilling a records request, the U.S. District Court for the Eastern District of Wisconsin said Jan. 31.

Moya’s attorney asked Walgreens for a copy of her pharmacy record. The pharmacy sent him a 5-page record and an invoice for $55. The amount was higher than the law allows, Moya said.
