Ninth Circuit Stands by Ruling OKing $3.6 Million Bard Judgment

C.R. Bard Inc. failed to convince the Ninth Circuit to revisit its decision upholding a $3.6 million judgment in the first federal test trial involving its blood-clot trapping filters.

In 2007, Sherr-Una Booker’s physician implanted a G2 filter in her inferior vena cava. The filter is meant to catch blood clots that break loose from a deep vein in the legs and prevent them from traveling to the heart or lungs. Booker’s filter fractured and perforated her inferior vena cava.
