A Pennsylvania man convicted of cocaine possession with intent to distribute will be resentenced after an appeals court determined Friday that the government didn’t find enough cocaine to support the charge.
Damon Carey was sentenced to 19 years in prison for cocaine possession and drug trafficking. He appealed his conviction to the US Court of Appeals for the Third Circuit, arguing that the government failed to prove that he possessed at least 500 grams of cocaine—as is required to support a trafficking charge.
