A trade group for private administrators of loans aimed at making homes more energy-efficient or prepared for disasters lost an early bid to block a Biden-era rule requiring them to provide the same disclosures as mortgage lenders.
The group, Building Resilient Infrastructure & Developing Greater Equity Inc., hasn’t demonstrated a substantial likelihood of success on the merits or a potential for irreparable injury—prerequisites to obtaining a preliminary injunction barring the rule from taking effect, Judge Tom Barber of the US District Court for the Middle District of Florida said in a Monday order.
