Yellow Gets Second Shot at Suit Faulting Teamsters for Implosion

A federal appeals court revived Yellow Corp.’s breach of contract lawsuit against the International Brotherhood of Teamsters and several local unions, permitting the bankrupt trucking company to amend its complaint with new facts to support its claims.

Yellow didn’t have a reasonable opportunity to amend its complaint based on documents that it obtained in discovery shortly before a federal judge in Kansas dismissed the case, the US Court of Appeals for the Tenth Circuit held Wednesday.
