XPO To Pay $30 Million to End Port Drivers’ Wage Class Suits

A federal judge in Los Angeles granted preliminary approval of two class settlements totaling $30 million between XPO Logistics Inc. and nearly 800 port drivers across California who alleged they were misclassified as independent contractors rather than employees.

The lawsuits were brought by Angel Omar Alvarez and Victor Cortes Arrellano in May and September 2018, respectively, on behalf of similarly situated drivers under California’s Labor Code and Private Attorneys General Act. The drivers primarily alleged that they were deprived of minimum wages, reimbursement for vehicle expenses, and compliant meal and rest breaks.
