XPO Drivers Who Deliver for Lowe’s Get Class Status in Wage Suit

Nearly 550 delivery drivers may proceed as a class on Massachusetts wage claims against XPO Logistics Inc. for allegedly misclassifying them as independent contractors, a federal judge in Boston ruled.

Common evidence about the drivers’ employment conditions can resolve whether they should have been treated as employees under the ABC worker classification test that Massachusetts uses and whether XPO is liable as a joint employer for any such misclassification, Judge Timothy S. Hillman said Monday.
