Worker’s Win in Pregnancy ‘Spit Cup’ Case Affirmed on Appeal

A Florida worker, who a jury found was illegally denied a “spit cup” for a pregnancy-related medical condition that caused her to produce excessive saliva, had $50,000 in damages reinstated and her win upheld by the US Court of Appeals for the Eleventh Circuit.

Fired clerical worker Timethia Brown provided sufficient evidence for the jury to find that Advanced Concept Innovations could have reasonably accommodated her by restructuring her job to exclude duties that raised cleanliness concerns, the court said on Thursday.
