Workers Failed to See Sean Penn Note as Threat, NLRB Judge Says

A National Labor Relations Board judge said that agency prosecutors failed to provide evidence showing a 2021 email from actor Sean Penn to his nonprofit’s employees was interpreted as a threat by the workers and dismissed the case.

Administrative Law Judge Lisa Ross said in her ruling released Monday that Penn’s email couldn’t be seen as threatening to workers and a violation of the National Labor Relations Act when the message instead was intended to “rally” employees.

The case stems from an unfair labor practice charge filed by an attorney unaffiliated with Penn’s disaster relief organization, Community Organized Relief Effort. ...
