FMLA Can Be Used for Reduced Hours, Labor Department Says (1)

Workers with serious health conditions can use their unpaid leave under the Family Medical Leave Act to reduce their hours on the job, the Biden administration said.

The US Labor Department’s Wage and Hour Division Thursday clarified in an opinion letter that eligible employees can use their job-protected FMLA leave to cover hours they would normally work in their shift and count it toward their overall FMLA leave entitlement until they run out.

“If the employee never exhausts their FMLA leave, they may work the reduced schedule indefinitely,” Principal Deputy Wage and Hour Administrator Jessica Looman wrote in the letter ...
