Workers’ BLM Protest Activity Not Shielded by Federal Labor Law

Workers at a Birmingham bar weren’t protected by federal labor law when they participated in Black Lives Matter protests against racial discrimination, the National Labor Relations Board ruled.

The Parkside Café employees’ activity in BLM demonstrations outside of work wasn’t aimed at improving their terms and conditions of employment, the NLRB held Wednesday.

The ruling underscores the limits to federal labor law safeguards for workers’ social justice activism, an issue that gained prominence after George Floyd’s 2020 murders parked protests nationwide.
