Worker Classification Ambiguity Concerning, Former Official Says

A former Labor Department official warned a congressional labor committee that employers and attorneys are in “disarray” after a federal court ruling on worker classification that caused confusion.

Tammy McCutchen, the US Labor Department’s Wage and Hour administrator under President George W. Bush, told the House Subcommittee on Workforce Protections Wednesday that she doesn’t know if the agency is following the law after a judge found that the Biden administration violated government rulemaking procedures by rolling back a Trump-era employee classification rule.

“Are they following the Trump regulations?” she said to Bloomberg Law after the hearing. “Nobody really knows.”
