A worker who lost her job at a scaffolding company after a positive drug test can move forward with allegations under a state medical marijuana law, but her wrongful discharge claim fell short.

The worker can’t show that her termination threatened clear public policy mandates, dooming her wrongful discharge allegations, but she’s free to pursue an alternative theory that BrandSafway Industries LLC discriminated against her because of her legal cannabis use, the US District Court for the Western District of Pennsylvania said.
