Winn-Dixie Stores Inc. secured a pretrial end to a lawsuit alleging it subjected a former manager to a hostile work environment based on her weight-related disability, a federal judge said.
The worker unreasonably waited at least 11 months to internally report her supervisor’s alleged fatphobic harassment, so the supermarket chain is entitled to an affirmative defense and a summary judgment ruling in its favor, the US District Court for the Southern District of Florida said Tuesday.
