Window Blind Installers Get Revival of Overtime Claims on Appeal

Three workers who installed window blinds sufficiently established that they worked extra hours without extra pay, but the lower court must still consider whether they’re employees entitled to overtime pay or not, the Fifth Circuit said Wednesday.

The FS Blinds LLC workers estimated that they spent 70 hours per week on average working for the company and put forth evidence showing that they weren’t paid overtime rates for all of their extra hours, so the district judge was wrong to grant the company summary judgment on that claim, the US Court of Appeals for the Fifth Circuit said.
