WinCo Foods Defeats Claims for Drug Testing Cost Reimbursement

A class of WinCo Foods LLC employees failed in their bid to compel the company to reimburse them for drug testing costs because they weren’t yet employees when they were tested as part of the job application process, the Ninth Circuit said Monday.

The employees took the drug tests after being offered positions at WinCo, a supermarket chain with over 100 stores, including several in California. The company requires successful job applicants to take drug tests. Alfred Johnson filed a class action seeking payment under California law for the time and travel expenses the workers incurred in taking the tests. ...
