Wilcox, Harris Seek Conditional SCOTUS Review of Trump Firings

Two independent agency officials removed by President Donald Trump plan to ask the US Supreme Court for early review of their firings if the justices take up a terminated Federal Trade Commission member’s case.

Attorneys for Gwynne Wilcox, former chair of the National Labor Relations Board, and Cathy Harris, former chair of the Merit Systems Protection Board, told the justices in separate letters Monday that they will file petitions for “certiorari before judgment.”

Their cases, which test independent agency members’ protections from removal by the president, are currently pending before the US Court of Appeals for the District of Columbia ...
