Whole Foods Workers Free to Appeal Now in BLM-Mask Bias Lawsuit

Whole Foods Market Inc. and Amazon.com Inc. workers had their path cleared to immediately appeal a Massachusetts federal judge’s near-total rejection of their lawsuit challenging a policy barring employees from wearing face masks or other attire bearing Black Lives Matter messaging.

The U.S. District Court for the District of Massachusetts on Thursday granted the workers’ request for entry of partial final judgment on its Feb. 5 ruling.

The decision dismissed from the proposed class action the race discrimination allegations of all 28 lead plaintiffs, 27 of whom work or worked for Whole Foods, an Amazon subsidiary. The workers lacked viable ...
