The Trump administration wants the US Supreme Court to overturn an appeals court decision questioning the authority of a federal civil service board.
The request to stay the decision, filed Friday, called for summary judgment and reversal of a ruling from the US Court of Appeals for the Fourth Circuit.
A Fourth Circuit panel in June ordered a lower court to reevaluate whether it has jurisdiction over administrative claims brought by the union representing federal immigration judges, suggesting that it does because of leadership shakeups at the Merit Systems Protection Board.
