Werner Mostly Fails to Limit Truckers’ Potential Wage Damages

Werner Enterprises Inc.'s bid to block the availability of some damages in a decade-old wage-and-hour dispute with truck drivers mostly fell short as the case heads to trial.

The workers can try to convince the jury they deserve waiting-time penalties, prejudgment interest, double and treble statutory damages, and some California Private Attorneys General Act damages when the trial starts next week, the US District Court for the District of Nebraska said. But Werner secured summary judgment precluding damages for too-old PAGA penalties, stacked penalties, and subsequent violations, the Thursday opinion said.
