Wayfair Beats Bias Claims of Worker Fired After Showing Up Sick

Wayfair LLC is free of a lawsuit alleging it engaged in disability discrimination when it fired a worker who came to a company warehouse while ill with Covid-19 symptoms before vaccines became widely available.

The worker failed to put forth an initial bias case because his bout of Covid-19 didn’t render him disabled under state law, the US District Court for the District of New Jersey said. Even if he cleared that bar, he didn’t show that Wayfair’s reason for firing him was pretext for discrimination, the unpublished Thursday opinion said.
