Walmart Wins Sixth Circuit Appeal Over Applicant Rejection

Walmart Inc. is not liable for revoking a job offer from an applicant who failed to disclose his criminal history, a federal appeals court said Tuesday.

The US Court of Appeals for the Sixth Circuit ruled that the applicant didn’t have standing to sue Walmart under the Fair Credit Reporting Act, upholding a district court decision. The applicant, Thomas Merck, filled out a background check form in 2016 attesting he had no criminal record, when in fact he was convicted of a misdemeanor 15 years earlier. The job offer was later revoked; Merck said he wasn’t told why.
