Walmart Pharmacist Sees Claim Over Immunization Rule Revived

A Walmart pharmacy manager fired for refusing to obtain certification to immunize customers can pursue a disability bias claim, the Second Circuit ruled March 11.

A lower court mistakenly concluded that William Noel failed to state a claim based on Walmart Stores East LP’s denial of his request to be excused from the new certification requirement because of his trypanophobia or “needle phobia,” the appeals court said in an unpublished opinion.
