Walmart Loses Appeal Bid in New York Pay Frequency Class Action

Walmart Inc. lost its bid for immediate higher court review of a ruling that New York workers can sue for damages if they were paid less frequently than on a weekly basis.

Neither Walmart nor a coalition of business groups that includes the US Chamber of Commerce showed that New York’s highest court would disagree with state appellate court precedent allowing pay-frequency lawsuits seeking damages, US District Judge Thomas McAvoy ruled Thursday.

Walmart’s request for review was pending before the Reagan-appointed judge for nearly a year.
