Walmart Limited in Bid to Probe EEOC Pre-suit Settlement Effort

The EEOC isn’t required to hand over to Wal-Mart Stores Texas LLC information regarding the details of the agency’s attempt to resolve a disability bias charge against the retailer prior to suing, the Southern District of Texas ruled.

A 2015 U.S. Supreme Court decision limiting judicial review of the Equal Employment Opportunity Commission’s pre-suit conciliation efforts applies equally to the documents and other information the agency must provide to an employer during discovery after a lawsuit has been filed, Judge Sim Lake said.
