Virtusa Defeats Worker Bid for South Asian Bias Row Class Status

Virtusa Corp. blocked workers from banding together in a race discrimination lawsuit when the plaintiff failed to show any of the proposed groups had enough members to justify class treatment.

The plaintiff estimated that there were hundreds of people in two of the proposed classes and thousands in the third, but she didn’t provide enough evidence to back up those numbers, the US District Court for the District of New Jersey said. Part of the problem is that she based the smaller estimates on an expert report, and the court already struck that report, Tuesday’s unpublished opinion said.
