Virginia Drops Out of Equal Rights Amendment Ratification Suit

Virginia won’t continue as lead plaintiff in a lawsuit seeking recognition of the Equal Rights Amendment, as newly elected Attorney General Jason Miyares has opted to drop out of the case.

The Republican attorney general notified the U.S. Court of Appeals for the District of Columbia in a filing Friday.

Virginia’s previous attorney general, Democrat Mark Herring, filed the federal lawsuit in January 2020, seeking a court order forcing the U.S. Archivist David Ferriero to publish the ERA as the 28th Amendment to the Constitution.
