Venezuelan Immigrant Files Tort Claim Against DHS Over Detention

A Venezuelan man is seeking monetary damages from the Department of Homeland Security after he was detained for eight days despite holding lawful status in the US.

The individual filed an administrative claim June 1 against DHS, Immigration and Customs Enforcement, and US Customs and Border Protection seeking $2 million in damages under the Federal Tort Claims Act. If the agency doesn’t respond or settle the claim within six months, or if it’s denied, an FTCA suit can be filed in federal court.
