A home appliance company is trying to avoid allegations that it violated federal labor law by arguing that the acting National Labor Relations Board general counsel’s appointment was expired when the agency issued the unfair labor practice complaint.
Coway USA Inc. claimed that the NLRB hit the company with ULP charges after acting General Counsel William Cowen’s 40 days in office allowed by federal vacancy law. The Trump administration failed to nominate a permanent GC in time to legally extend Cowen’s acting status, Coway alleged.
