A group of Valentino USA Inc. employees can’t proceed as a certified collective in their Fair Labor Standards lawsuit alleging the luxury fashion brand misclassified them as exempt from overtime pay, a federal judge in Manhattan ruled.
The five plaintiffs failed to prove that they and similarly situated employees were subjected to a single companywide policy or practice that violated the FLSA, Judge Mary Kay Vyskocil of the U.S. District Court for the Southern District of New York said Monday in denying their motion.
