VA Worker Loses Bid to Revive Parking Space Disability Bias Case

A retired Department of Veterans Affairs worker failed to revive allegations that the agency’s pandemic-era safety measures interfered with his disability accommodations, a federal appeals court said.

Covid-19 protocols temporarily closed the hospital entrance closest to the worker’s reserved parking spot, which the VA assigned to accommodate his mobility issues. The worker declined the agency’s alternative reserved spot, but no reasonable jury could conclude the VA failed to offer him a reasonable accommodation, the US Court of Appeals for the Seventh Circuit said Monday.
